About 300 Afghan women, facing an angry throng three times larger than their own, walked the streets of the capital on Wednesday to demand that Parliament repeal a new law that introduces a range of Taliban-like restrictions on women, and permits, among other things, marital rape.
"Whenever a man wants sex, we cannot refuse," said Fatima Husseini, 26, one of the marchers. "It means a woman is a kind of property, to be used by the man in any way that he wants."
One provision makes it illegal for a woman to resist her husband's sexual advances. A second provision requires a husband's permission for a woman to work outside the home or go to school. And a third makes it illegal for a woman to refuse to "make herself up" or "dress up" if that is what her husband wants.

The cleric, Mohammed Hussein Jafaari, (answered) "This law was approved by the scholars. It was passed by both houses of Parliament. It was signed by the president."
He said it was between professionals and nonprofessionals; that is, between the clerics, who understood the Koran and Islamic law, and the women calling for the law's repeal who did not.
The religious scholars, Mr. Jafaari conceded, were all men.
Mr. Jafaari said that what was really driving the dispute was the foreigners who loomed so large over the country.
"We Afghans don't want a bunch of NATO commanders and foreign ministers telling us what to do."

Kit wanted his students to ask questions and challange what they heard and said, even what he said.
Kids were active and talkative in his classes, and often talked about them at home.
A number of parents complained that their children questioned what they told them instead of showing them respect.
They said the teacher should be teaching the same answers they taught their kids and follow Thai custom.

- The parents filed a complaint with the head of the school and the village to replace Kit.
- They said: "What our kids need is answers to pass the national entrance exams so they can go to university and get a good job."
- Kit answered that the world is changing and kids need to find out for themselves what these changes mean, so they can adapt.
- The parents said it was foreigners causing the changes and they didn't need to follow them.
The Fed is leading the assessments, which are designed to ensure that banks and financial firms
have enough capital to weather a deeper economic downturn over the coming
two years.
Banks will begin to get preliminary results from the reviews on April 24, the
same day the Federal Reserve is scheduled to release the methodology for the
exams.

Regulators conducting the stress tests are increasingly focusing on the quality
of loans banks made after finding wide variations in underwriting standards, a
regulatory official said on April 20. They concluded that banks’ lending
practices need to be given as much weight as macroeconomic scenarios in
determining the health of each bank, the person said. From this Bloomberg article » By Robert Schmidt.

Editors note: This Simplified Mock Trial encourages students to examine the responsibility and accountability of decision makers.
The Prosecutor alleged that the failure of The Mortgage Writer to check the accuracy and reliability of the loan applications he/she approved had passed along and multiplied the risk of failure for each mortgage approved which contributed to the collapse of confidence in the banking system.

The Mortgage Writer answered that the practise of accepting loans on the word of the borrower and ignoring their ability to pay had become common place in the banking and investment industry.
The Mortgage Writer claimed that the danger to the bank was small since the bank had packaged groups of these Sub Prime Mortgages and sold them to investors as stock offerings.
The Mortgage Writer claimed he/she should not be held responsible for the damage of these mortgages since the risk of failure had been safely spread to reduce the chance of the bank or investors suffering excessive losses, and in fact until recently they were quite profitable.

It is based on this » New York Times article - By Keith Bradsher

Most people in Taiwan have seen the image of former President Chen holding his handcuffed wrists above his head last November and shouting “political persecution” when he was arrested on corruption charges.
So a scene in a skit last month performed in front of more than 200 of the island’s judges and prosecutors — some involved in deciding Mr. Chen’s fate in his coming trial — came as a surprise. A prosecutor acting in the skit held her wrists together over her head and yelled, “judicial persecution.”
Taiwan does not have jury trials which would allow the accused to choose whether judges, who are appointed by the government, or ordinary people, selected as a jury, should decide their guilt or innocence.
Chen Shui-bian has asked the court to drop the charges against him citing the behaviour of the prosecutors and judges shows they have already decided his guilt and he will not be given a fair trial.

Japan, after a lapse of 60 years, is planning to bring back a jury system -
The return to citizen participation represents a bold commitment to have ordinary Japanese take greater responsibility in running the country. If a jury is sufficiently unhappy with the government's case or the government's conduct, it can simply refuse to convict. This possibility puts powerful pressure on the state to behave properly and ultimately leads to better governance. For this reason, a jury is one of the most important protections of a democracy. The full article - By Robert E. In addition to demanding that Samak resign, they want an overhaul of Thailand's system of government, saying only 30 percent of seats in parliament should be elected (so 7 out of ten Thai voters will not be allowed to vote), with the rest appointed.

Thitinan Pongsudhirak is a professor of political science at Chulalongkorn University. He says the current round of anti-government protests is different from those of previous years and could set a "bad precedent" for Thailand.
"It's a dangerous trend," Thitinan said. "I'm not a fan of the PPP," he said of the governing party, "but you have an elected government, and you have 10,000 people taking to the streets who want to overthrow it."

This Simplified Mock Trial encourages students to examine the issue of subsidizing fuel costs. The facts are based on a Bangkok Post article describing a ruling by the Thai Central Administrative Court to freeze bus fares in Bangkok while it considered a consumer groups case against private bus operators.

The Private bus operators in this Simplified Mock Trial answer:
The ruling by the Administrative Court to freeze the fares places the entire burden of absorbing the added cost of fuel costs on the private bus companies and assumes that the facts presented by the Consumer Group are correct before examining them.
Therefore the Private bus operators ask the Court of Appeal to overturn the ruling by the Administrative Court until the facts in the case are examined.

Traffic would come to a halt every time the national anthem is played under new proposals to promote patriotism in Thailand.
Opponents of the Flag Bill, put forward by a group of retired and current generals, say it would cause chaos on the roads.
The minute long national anthem is played twice a day in Bangkok, during the raising and lowering of the flag, reports Sky News.
Retired General Pricha Rochanasena, 70, said: "The national anthem lasts only one minute and eight seconds.
"So why can't motorists stop their cars for the sake of the country? They already spend more time in traffic jams anyway."
But a vote on the Bill in the (military appointed parliament) has been deferred to allow a committee to see whether it would work in practice.
Politician Wallop Tangkananurak, who is opposed to the proposal, said: "It would be chaotic if the Bill had passed as it is now."

Google argues that if Microsoft's hostile bid for Yahoo succeeds Microsoft will be able to stifle innovation and leverage its dominating Windows operating system to set up personal computers so consumers are automatically steered to online services, such as e-mail and instant messaging, controlled by the world's largest software maker.
Microsoft answered, that the acquisition raises competition, rather than eliminates it, in the Web advertising market. Google's clearly got a dominant position with about 75 percent of paid search world wide.
Preventing Microsoft from buying Yahoo would undermine competition by allowing Google to become even more dominant than it already is on the Internet.

Oscar Pistorious petitioned the International Association of Athletics Federations (I.A.A.F), which decides who can compete in the Olympics in Beijing, to allow him to compete.
The I.A.A.F ruled that the double-amputee sprinter, who runs on two carbon-fiber blades, was ineligible to qualify for the Olympics. The ruling stated that Pistorius’s J-shaped blades were a “technical aid,” and could not be used in an able-bodied competition.

Oscar Pistorius asked the Court of Appeal to examine qualification to compete while using of an assistive device, not only in solely biomechanical terms.
"These have always been my legs. I train harder than other guys, eat better, sleep better and wake up thinking about athletics. I think that's probably why I'm a bit of an exception."
There are many disadvantages to sprinting on carbon-fiber legs, Pistorius and his coach said. After a cumbersome start, he needs about 30 meters to gain his rhythm. His knees do not flex as readily, limiting his power output. His grip can be unsure in the rain. And when he runs into a headwind or grows fatigued, he must fight rotational forces that turn his prosthetic devices sideways, said Ampie Louw, who coaches Pistorius.
My legs allow me to run, but to win I face the same challenges as every other Olympic runner, and I am asking the Court of Appeal to overturn the decision of the I.A.A.F, so I can compete in the 2008 Olympics.

The Malaysian authorities' refused to renew the publication of the weekly Catholic newspaper The Herald unless it stops using the word Allah as the word for God in the Malay language.
According to Deputy Internal Security Minister Johari Baharum, "Only Muslims can use 'Allah'. It's a Muslim word, you see. It's from (the Arabic language). The word 'Allah' is published by the Catholics. It's not right. We cannot let other religions use it because it will confuse people." he was reported as saying.

The Newspaper answered, Muslims, like Christians, do not worship a person called Allah. They worship a single supreme being, which the Arabic language denotes as Allah.
An English Koran uses the words "In the name of God the compassionate and merciful," not "In the name of Allah the compassionate and merciful."
For Muslims, Jesus was a prophet of Islam, and the Koran represents the continuation of God's revelation begun in the Old Testament.
If Malaysian Malays are confused about the distinction between Islam and Christianity because they use the same word to describe the one God, clearly there is a lot wrong with the educational system.

- As early as 1 A.M. the crows from Nang's roosters bounced and echoed along the rows of five story Chinese shop houses in his neighbourhood.
- Nang had brought them when he moved from the country, so he and his family would feel more at home in the city.
- But they didn't.

Weeks turned into months and then a year before Tong , whose house was across the street, could stand no more.

- Tong filed a complaint accusing Nang of disturbing the people in the neighbourhood and asked the court to order that the roosters be removed.
- Nang answered that his roosters were a normal part of Thai life and his family loved them, so it was unfair to ask him to go without them.
- Tong responded that roosters may be a normal part of Thai life in the country, but Nang had moved to the city where the roosters were causing headaches for the people who could not sleep because of them.

The Lower Court Judge ruled:
- Mr. Gordon should be more careful when preparing to enter a highway, since there are other people using the highways and his car is bigger and can cause them a lot of damage.
- He wrote that Mr Gordon had not been careful enough and a young boy was hurt.
- He ordered Mr. Gordon to pay for Nong’s medical costs as well as the court and legal expenses his family spent bringing the case to court.

Mr. Gordon did not agree and presented these facts and reasons to the Court of Appeal to consider:
- Mr. Gordon followed every traffic law and safe driving practice, which the facts in the trial proved.
- Nong was an inexperienced 13 year old driver who had never taken a driving test or obtained a license to drive and was driving with an injured foot in the wrong direction on a four lane highway when he ran into Mr. Gordon's car.
- Nong had been the cause of the accident.
- Mr Gordon claimed that the Lower Court ruling ignored the facts in the case and the law and therefore could encourage the general public to also ignore laws that protected everyone.

In this lesson, as we consider a criminal case, we see that the state is bringing charges against an individual for committing an offence that is considered a wrong to society as a whole.

The accused is a grade five student at Brightview Elementary School. During morning recess, the school janitor heard some strange noises coming from the washroom. The janitor went in to the washroom to investigate the situation and discovered the accused writing on the walls. Two toilets were plugged with toilet paper and the water was beginning to run all over the washroom floor. The accused was the only person in the washroom and the janitor knew the toilets were not plugged five minutes earlier.

The accused has been charged with the offence of "committing public mischief;" meaning the willful destroying or damaging of public property. The accused pleads "not guilty" to the charge. Remember that the accused is presumed innocent until proven guilty. Therefore if the crown, or state, cannot gather together enough evidence to prove its case, the case will be dismissed without the accused ever having to give evidence. If found guilty, the accused person will be punished. Go to this Canada School Net Simplified Mock Trial.

Good rules can be followed (that is, are within societal values).

Good rules state the penalty for disobeying.
